What is FSMA 204 and the FDA Food Traceability Rule?
The rule adds records to the highest-risk foods so an outbreak can be traced in hours, not weeks. Here is where it comes from, who it reaches, and the shape of what it asks.
FSMA 204 is shorthand for section 204 of the FDA Food Safety Modernization Act. That section directed FDA to identify foods for which additional recordkeeping would help protect public health, and to set the records that persons handling those foods must keep. The result is the Food Traceability Rule, which lives at 21 CFR Part 1, Subpart S. It was finalized in November 2022.
The idea behind it is simple even though the detail is not. When people get sick from a contaminated food, investigators have to work backward from a store shelf through distributors, processors, and packers to the source, and forward again to everywhere else that lot went. Done on paper and phone calls, that can take weeks, and by then more product has moved and more people are exposed. FSMA 204 standardizes the records so the same key facts exist at every step and can be pulled together fast.
Who the rule reaches
The rule applies to persons who manufacture, process, pack, or hold a food on the Food Traceability List (FTL). Coverage follows the food, not the company, so it can apply at each point in the supply chain unless a specific exemption applies. It reaches domestic operations and importers of FTL foods. If you handle a listed food, or a food that contains a listed food as an ingredient in the same form it takes on the list, the rule can reach you.
There are exemptions, and some are significant. Small produce farms under a $25,000 sales threshold, small retail food establishments and restaurants under a $250,000 threshold, transporters, direct-to-consumer farm sales, and foods that receive a kill step are among them. The shape of what it asks
Three pieces do most of the work.
1. A traceability lot code
The whole system hangs on a traceability lot code, a single identifier that ties a food to its records. It is assigned at defined points (initial packing of a raw agricultural commodity, first land-based receiving of a fishing-vessel food, and transformation), then it travels with the food. Every later handler records it and matches back to it, which is what makes the chain traceable.
2. Records at Critical Tracking Events
Records attach to specific events, called Critical Tracking Events (CTEs): harvesting, cooling, initial packing, first land-based receiving, shipping, receiving, and transformation. At each event that applies to you, you record a set of Key Data Elements, the specific fields the rule names, such as the lot code, a product description, quantity, location descriptions, dates, and the reference document type and number. Which events and which fields apply depends on your role in the chain.
3. A traceability plan
Every covered person keeps a written traceability plan describing how they keep the records, how they identify FTL foods, how they assign lot codes, and who the point of contact is. Growers also keep a farm map. The plan has to be kept current, and prior versions retained for two years.
When it applies
As at July 12, 2026, FDA will not enforce the Food Traceability Rule before July 20, 2028. The original date was January 20, 2026; a proposed 30-month extension and a congressional non-enforcement directive moved the operative date to July 2028. The records demand you are building toward
The reason all of this matters is the back end: when FDA asks, a covered person must make the required records available within 24 hours, and during an outbreak or recall FDA can ask for them as an electronic sortable spreadsheet within 24 hours. If your records are scattered across formats and systems, that is a hard ask on a hard day, which is why the rule pushes you to design the capture up front.
