Terms of Service

The terms that govern your use of FSMA 204 Traceability Report and your purchase of a report.

Effective date: July 12, 2026

These Terms of Service ("Terms") govern your use of FSMA 204 Traceability Report at fsma204check.com and your purchase of the report we provide (a screening report of the FDA Food Traceability Rule obligations that apply to your food business). By using this site or buying a report, you agree to these Terms.

1. What you are buying

FSMA 204 Traceability Report sells a one-time screening report for $39. The report screens the role and foods you supply against 21 CFR Part 1 Subpart S and presents the obligations that appear to apply, each cited to its section, with per-event data-element templates and a traceability-plan starter.

2. The report is a screening, not legal advice

The report is provided for general informational purposes only. It is a screening of your answers against the rule, not a professional service, and it is not, and must not be relied on as, legal, compliance, regulatory, or any other professional advice. It is not an official compliance determination, inspection, or certification, and it does not create a professional-client relationship. It is not a substitute for advice from qualified counsel or a measurement from an accredited lab. You are solely responsible for any decision you make, and you should consult an appropriately qualified professional before acting on anything in the report.

3. Independence and no affiliation

FSMA 204 Traceability Report is an independent tool. It is not affiliated with, endorsed by, or acting on behalf of the U.S. Food and Drug Administration or any government agency. 21 CFR Part 1 Subpart S and FDA guidance are cited as public sources.

4. No warranty

The report and this site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The rule is exacting, its enforcement date and some figures depend on measures that may change, and public sources can contain errors, gaps, or out-of-date figures. We do not warrant that the report is accurate, complete, current, or fit for any particular purpose.

5. Limitation of liability

To the maximum extent permitted by law, FSMA 204 Traceability Report, its operators, and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or the report. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the report or these Terms will not exceed the amount you paid for the report ($39).

6. Refunds

Because the report is a digital product delivered immediately, refunds are provided for delivery failure, for example if you paid but did not receive your report, or the report could not be generated for the parameters you supplied. If your report failed to arrive or cannot be produced, email hello@fsma204check.com and we will re-deliver it or refund your purchase. If you believe a specific point in your report is wrong, contact us; we will investigate and, where a delivery or generation fault is on our side, make it right.

7. Acceptable use

You agree not to: resell, republish, or redistribute the report as your own product; scrape, bulk-download, or systematically extract content from the site; attempt to disrupt, overload, or gain unauthorized access to the site or its infrastructure; or use the site or report for any unlawful purpose. The report is licensed to you for your own internal business use.

8. Intellectual property

The site, its design, its text, and the report format are owned by FSMA 204 Traceability Report and protected by intellectual-property laws. Underlying public sources referenced in the report, including 21 CFR Part 1 Subpart S, belong to their respective authorities. We grant you a limited, non-exclusive, non-transferable license to use the report you purchase for your own purposes.

9. Third-party services

Payments are processed by Stripe under Stripe's terms. Analytics are provided by Fathom Analytics. We are not responsible for the practices of third-party services, though we choose them with your privacy in mind (see our Privacy Policy).

10. Governing law

These Terms are governed by the laws of the United States and, to the extent applicable, the state in which the operator of FSMA 204 Traceability Report is established, without regard to conflict-of-laws rules. You agree that any dispute will be brought in the courts located there.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.
